Mr. Grover has over 26 years of experience in analyzing and preparing claims relating to construction matters (e.g., identification and quantification of impact events; effect of change orders, design changes and out of sequence work; and impact of quantity changes and unit price changes), government contracts, business interruption, lost profits, valuation and environmental matters, as well as management consulting services.

Mr. Grover has also testified as an expert witness concerning economic damages related to construction, operating and maintenance costs, business interruption, business valuation, lost profits, repair and restoration costs, betterment, employment wage and discrimination costs, as well as trade secret related matters. He has also presented analyses to various parties including U.S. Department of Justice, U.S. Attorney’s Office, Office of the Inspector General, and States Attorneys General.

Mr. Grover is experienced in various industries, including commercial and residential construction, electric power, casinos, railway, highway, steel production, manufacturing, shipping, building inspection, restaurant and banquet facilities, hotel, apartment, condominium, real estate, environmental cleanup, and state-operated healthcare programs.

Prior to joining Exponent, Mr. Grover worked with several consulting firms providing financial, accounting, and engineering-related consulting services, in the litigation and business management arena, to numerous clients in a variety of industries. He is also a former structural engineer with the Bechtel Power Corporation where he performed engineering design, modification, inspection, and startup testing activities on several nuclear power plants that were under construction or down for maintenance.

Construction Claims

Significant experience in analyzing and preparing claims relating to construction cost growth including: identification and quantification of impact events; effect of change orders, design changes and out of sequence work; and impact of quantity changes and unit price changes.

Supervised performance of schedule analyses including determination of critical path, identification of events delaying projects, determination of causation of delay and allocation of impacts to the responsible party(s).

Conducted analyses of schedule acceleration and labor productivity impacts occurring during the construction of various complexes.

Conducted reviews of bids for omissions and errors in both the cost and schedule areas of projects as well as performed reviews of the actual costs charged to projects.

Conducted reviews and analyses of construction impacts, cost overruns and projected costs to complete projects to assist investment firms in analyzing financing strategies.

Conducted a review of costs associated with the replacement of residential piping that was reported to be failing prior to achieving the anticipated useful life of the product.

Performance of analyses and reviews has been associated with sports arenas, hotel renovation, steel processing facility, steel fabrication, apartment and condominium buildings, cogeneration plants, transit systems, manufacturing facility, casinos, parking structure, water distribution system and others.

Utility and Power Plant Matters

Retained by an electric utility company to review the repair costs and schedule related to an accidental outage resulting from a turbine failure. Analysis included the examination of the approximately $270 million in repair costs to determine the costs associated with expediting the repair efforts. Also reviewed costs associated with specific issues for which the insurance company denied reimbursement. 

Prepared analyses, on the behalf of the project owner, of the impact on construction costs and operating and maintenance costs that were the result of improper advise and design that was provided by the project’s construction manager/design engineer. The project involved the design and construction of an islanded cogeneration power plant that was cancelled after a substantial portion of the construction was completed. The jury awarded the full claimed amount (over $52 million) to the owner.

Assisted in the defense of defective design, material and workmanship claims associated with cogeneration facilities including performance of analysis to determine impact of improper assembly and operation.

Performed analysis comparing the economics and environmental factors, in the United States as well as worldwide, of operating nuclear powered generating plants to those of alternate fuel generating plants.

Assisted utility in prudence review of the construction of nuclear power plants including the causes for, and amount of, various cost increases and schedule delays.

Assisted utility in the review of plant operating records to determine the root causes for the operating and maintenance cost expenditures incurred during an extended plant outage.

Performed review of a biomass plant that failed to successfully operate as intended. Review included identification of options available to bondholders to minimize losses.

Business Interruption, Lost Profits, Valuation, and Other Damages

Analyzed lost profits on terminated contracts and projected future contracts, as well as the impact on the business valuation as a result of the lost contracts.

Analyzed repair and restoration costs as well as business interruption costs that resulted from an electrical power failure. Services were provided to a government entity.

Analyzed individuals’ lost income and pension benefits associated with employment related disputes, including wage discrimination, lack of payment for overtime and minimum wages issues.

Analyzed impact of paying wage premiums to maintain production schedule and collection of accounts receivable due to union’s actions.

Analyzed financial transactions of foreign company to identify and quantify funding sources, distribution of funds, and expenses incurred to determine if minority partner was receiving appropriate share of income.

Assisted international port facility in identification and quantification of financial losses resulting from a major earthquake. Analysis of losses included repair and replacement costs, lost revenue, productivity impacts, additional expenses and usage fees, and toxic substance removal costs.

Analyzed apartment complex project operation to evaluate weather-related impacts and subsequent retrofit work. Evaluation included analyses of unit vacancies, additional expenses, concessions, lost parking revenue, among other items.

Analyzed fire related impacts on several businesses. Also analyzed impact of management changes on minority shareholder value, including business valuation, and related lost profits.

Analyzed impact of trade secret and patent related theft, including business valuation and related lost profits.

Government Contracts

Performed analyses of developmental design and manufacturing contracts to determine the impacts associated with constructive change orders, formal change orders, superior knowledge issues, supplier and vendor delays, disruptions, inefficiencies and acceleration.

Assisted in the preparation of claims for reimbursement of costs associated with contract restructuring and terminated contracts including performance of schedule analyses to identify delay impacts and periods of concurrency. Conducted analyses to determine causation of impacts and identification and quantification of periods of compensable delay.

Analyzed contract and design changes as well as both submitted and outstanding claims by contractor on lump sum bid. Quantified impacts of potentially fraudulent claim submissions by contractor and subcontractor. Acted as contract manager for prime contractor, prepared submissions to government for outstanding claims and payment applications, reviewed claims and correspondence submitted by government and subcontractor, and advised counsel and contractor of recommended actions and responses.

Management Consulting 

Analyzed maintenance and construction services of several state agencies. Analyses included level of personnel experience, use of tracking and planning mechanisms, cost of operations, organizational structure, contracting effort, and budgeting and schedule performance. Assisted agencies in structuring plans to reduce costs, increase service, streamline operations and avoid or reduce the impact of disputes. Also assisted state agency in identifying methods to reduce energy consumption, maximize use of federal or state funding streams and utilization of alternative project financing mechanisms.

Conducted a review of potential economic impacts resulting from modifications necessary to correct alleged defective design and subsequent limitations on the use of a structure. Review included identification of loss of customers, increase in operational costs and impact on the useful life of the structure.
