Mr. Mirfatahi advises clients on a range of topics including project controls, project engineering, risk management and dispute resolution with over 10 years of experience in construction. He assisted teams to successfully execute all phases of projects and provided dispute resolution services for approximately $1 billion of projects. Mr. Mirfatahi has worked in all aspects of construction including engineering services, estimating, scheduling, contracts, procurement, change management, and project management. His experience with construction disputes includes the analysis and defense of construction claims related to delays, cost overruns, change of scope and loss of productivity.

Mr. Mirfatahi’s project experience includes oil and gas facilities, deep-water and marine structures, wastewater treatment plants, pipelines, industrial facilities, heavy civil, highways, multifamily, mixed-use and condominiums.

Prior to joining Exponent, Mr. Mirfatahi worked as a consultant for Spire Consulting Group and Arcadis. Additionally, Mr. Mirfatahi worked for a general contractor and engineering service company in oil & gas and deep-water projects.

Project Experience

Buildings & High-rise

Residential: Analyzed delay claim, on behalf of the owner, involving construction of an assisted living facility in Texas. The analysis included a report for a time extension attributable to delay, disruption and additional costs due to late permits and differing site conditions.

Hotel: Provided claims services, on behalf of the owner, to prepare a presentation on initial findings concerning the delays to the construction of a 13-story hotel located in New York. Findings were presented in an independent report for the purposes of mediation.

Mixed-Use: Performed an independent schedule review and project management services, on behalf of the owner, for construction of a new mixed-use building in Iraq. Findings were presented in an independent report for the purposes of the contractor’s request for equitable adjustment.

School: Provided claims services, on behalf of the owner, involving flawed work and warranties for a school in Texas. The project included deficiencies in pavements, drainage system, roofing, sport courts and the main building. Findings were presented in the form of a rebuttal report for mediation.

Residential: Performed scheduling and project management services, on behalf of the owner, for construction of a new residential complex in Texas.

Mixed-use: Performed an independent schedule review and project management services, on behalf of the owner, for construction of a new mixed-use building in California.

Residential: Provided pre-construction services including reviewing project estimates, schedules and analyzing design documents for constructability for a 12-story condominium in California.

Industrial

Dam: Evaluated claims, on behalf of the owner, arising from delays, disruption and loss of productivity for rehabilitation of a dam in New York. The project included structural improvements, new spillways, retaining walls, utilities upgrade and replacement. Findings were presented for the purpose of mediation.

Water Treatment plant: Provided pre-construction and scheduling services, for rehabilitation of two water treatment plants and one pumping station in New York.

Transport

Transit Center: Provided delay analysis, on behalf of the general contractor, arising from delays and extra cost due to design changes, unforeseen site conditions, repair works and commissioning of a transit center in California. The project included construction of a world-class facility including train deck, bus deck, shopping center and roof park.

Road: Analyzed delay claim, on behalf of the owner, involving repair and reconstruction of a road in Texas. The work involved the preparation of a report for an extension of time and reimbursement attributable to delay and disruption. Findings were presented in an independent report for the purposes of a contractor’s request for equitable adjustment.

Highway: Provided claims services, on behalf of the contractor, arising from delays and disruption to construction of a highway in Texas. The project included new paving, sidewalks, drainage, retaining walls, ripraps, utilities and landscaping. Findings were presented in an independent rebuttal report.

Bridge: Evaluated claim, on behalf of the sub-contractor, arising from changes orders, design changes, nonpayment and disruption. The work included installing the prefabricated concrete work and tensions module for a bridge in Texas. Findings were presented in an independent report.

Airport: Performed independent schedule review and updates on behalf of the owner, for construction of a new fueling facility in Guam.

Oil, Gas & Chemicals

LNG/LPG Terminals: Assisted in construction management and commissioning, on behalf of the general contractor, of three EPC loading docks in Texas. These projects involved the full life cycle from bid to commissioning of all prefabricated modules, mechanical, electrical, piping, machinery parts along with required onsite work.

Loading Dock: Assisted in construction management and commissioning, on behalf of the general contractor, of an EPC salt loading dock in the Bahamas. This project involved the full life cycle from bid to commissioning of all prefabricated modules, mechanical, electrical, piping, machinery parts along with required onsite work.

Marine Structures: Assisted in design and stress analysis of pipe-laying vessels and subsea manifolds in Texas, Alaska and Australia.

Power Plants: Assisted in pre-construction services and preliminary engineering of floating gas power plant in Africa.

Pipelines: Assisted in design, stress analysis and construction management of subsea pipelines in Indonesia, Texas and Australia.
